As you know, Christo recently announced a temporary delay in the Over The River exhibition period because of two lawsuits and a regulatory appeal before the Interior Board of Land Appeals (IBLA) that are working their way through the legal process. Christo decided that it was not a prudent decision to actually begin the installation phase before these legal challenges have been resolved.

You may have read in the papers last week that the judge in one of the cases issued a ruling. And, some of the articles implied that this decision was far more significant than it was. We wanted to send this email update to let you know what this ruling meant.

The IBLA decision is expected in the next few months. An opposition group, ROAR, had asked the judge to give them 180 days after the decision was issued so they could decide whether to file a motion asking for an injunction preventing Christo from building the project. Last week, the judge decided to give ROAR 60 days. This ruling has virtually no impact, however, because the project does not have an exhibition date and won’t have a date until the two other legal proceedings have concluded. As a result, there is no installation activity to stop and this ruling has no practical impact on Over The River.

Some of the articles that ran caused some confusion so we wanted to clear this up. The legal process can be a long one so this is not likely to be the last legal development that you will hear about. We will work to keep you updated.
